A Deeper Dive into Canada’s Defence Trade Controls: Addressing Challenges in Controlled Goods Program Compliance

Although the Defence Production Act Controlled Goods Program has been in force for almost 20 years, organizations continue to face significant compliance and enforcement challenges in meeting their obligations under the CGP. This webinar will provide both existing and prospective CGP registrants with an overview of the key issues arising with day-to-day compliance, especially for technology and intangible transfers, and discuss practical strategies for mitigating risk exposure.

It is designed for defence contractors and those operating in other sectors covered by the CGP, as well those that work with them, such as universities and other institutions of higher learning, consultants, brokers, transportation services, legal counsel, and other service providers.

 Attendees will also have an opportunity to raise and discuss issues during a substantive 30 minute Q&A portion of the program.

 Topics will focus on specific areas where organizations often run into compliance difficulties, including:

  • do we really need to register in the CGP? will the Controlled Goods Directorate allow us to?
  • do we have to security assess all employees? the pros and cons
  • dealing with intangible controlled goods – controlled technology and mitigating non-compliance exposure in the “cloud”
  • how do we deal with our IT employees and external service providers?
  • what do we need to tell the Controlled Goods Directorate about changes at our organization?
  • we are being acquired – what do we need to do now under the CGP?
  • how do our obligations under export and technology transfer controls and economic sanctions laws relate to the CGP?
  • how does the CGP interact with requirements under the US ITAR? dealing with US partners subject to ITAR
  • addressing potential conflicts with human rights and employment law
  • what do we do when we discover possible non-compliance? investigations and breach report

Who should attend: Designated Officials, company general counsel and compliance officers, service providers, consultants and legal counsel, and those in the university and academic community who work with the defence sector.
